to register a subscription for flower delivery
This document is an official proposal (public offer) of KvitoCenter, legal address: Tekstilna 42 (hereinafter referred to as the “Seller”), to conclude an agreement on the provision of subscription delivery services for flower arrangements with any individual or legal entity (hereinafter referred to as the “Customer”) that accepts the terms of this Offer (hereinafter referred to as the “Agreement”).
1. General provisions
1.1. The Offer is an official proposal of the Seller to conclude an Agreement on the provision of subscription flower delivery services.
1.2. Acceptance of the Offer (full and unconditional acceptance of the terms) is carried out by the Customer by paying for the selected subscription package.
1.3. The Offer is public and is valid until it is revoked by the Seller.
1.4. The Seller has the right to change the terms of the Offer by publishing them on the official website. Changes do not apply to already paid subscriptions.
1.5. A flower subscription provides for regular delivery of flower arrangements in accordance with the selected tariff plan.
1.6. A paid subscription is not subject to refund or cancellation.
1.7. All payments for the subscription are made exclusively online.
2. Subject of the Agreement
2.1. The Seller undertakes to provide a flower arrangement delivery service in accordance with the subscription package selected by the Customer, and the Customer undertakes to pay for the service on the terms stipulated in this Agreement.
2.2. The subscription provides for periodic delivery of flowers according to the selected schedule.
2.3. The subscription cost includes florist services, packaging, design and delivery to the address specified by the Customer.
2.4. The Customer cannot choose the style of the arrangements; the filling of the bouquets is determined by the Seller depending on the availability of seasonal flowers.
2.5. All flower arrangements are formed individually, based on the available assortment, so their exact composition may differ from the samples on the site.
3. Payment terms
3.1. Payment is made by 100% prepayment for the selected period.
3.2. Payment is possible only online through payment systems on the Seller's website.
3.3. In case of untimely payment, the Seller has the right to suspend the fulfillment of its obligations.
3.4. Refunds for prepaid subscriptions are not provided.
4. Rights and obligations of the parties
4.1. The Seller undertakes to:
• Ensure high-quality delivery of flower arrangements in accordance with the tariff selected by the Customer.
• Comply with the confidentiality conditions regarding the Customer's data.
• Make delivery within the established deadlines, except for force majeure circumstances.
4.2. The Customer undertakes to:
• Provide up-to-date and reliable data for delivery.
• Pay for services on time.
• Accept delivery at the specified time or notify of a change in the delivery date 24 hours before the scheduled date.
4.3. The Seller has the right to:
• Make changes to the composition of the compositions depending on the availability of flowers.
• Refuse to provide services in the event of the Customer's violation of the terms of the Agreement.
• Suspend or cancel the subscription in the event of non-payment.
4.4. The Customer has the right to:
• Receive the service in accordance with the selected package.
• Change the delivery address upon prior agreement with the Seller.
• Issue a subscription as a gift for a third party.
5. Refusal to refund and replace the product
5.1. A paid subscription is not subject to refund or cancellation at the initiative of the Customer.
5.2. If the delivery was not made due to the Seller's fault, re-delivery will be made on another day.
5.3. The Seller reserves the right to replace individual flowers in the composition without prior agreement if certain types of flowers are not available.
5.4. In the event of the Customer's refusal to accept the order without a valid reason, the funds will not be refunded.
6. Force majeure
6.1. The Parties are exempt from liability for failure to fulfill obligations in the event of force majeure circumstances (force majeure), which are documented by the relevant authorities.
7.
Confidentiality and protection of personal data
7.1. The Customer consents to the processing of his personal data in accordance with the current legislation of Ukraine.
7.2. The Seller guarantees that the Customer's personal data will not be transferred to third parties, except in cases provided for by law.
8. Final provisions
8.1. By accepting this Offer, the Customer confirms that he has read and agrees to its terms and conditions.
8.2. All disputes are resolved through negotiations, and in case of failure to reach an agreement - in court in accordance with the current legislation of Ukraine.
